Terms and Conditions (December 11, 2005)

Please read the following carefully. when you place an order with us you are accepting these terms and conditions.

1. Registration

a. You are the customer. the terms ‘we’, ‘us’ and ‘our’ mean beiker products limited.

b. You must register with us in order to use the site for ordering goods. you accept that all the details you provide in the registration are accurate.

c. When you register you receive a password. this must be kept confidential, as you are entirely responsible for all orders placed with us or information given to us under your e-mail address in combination with the password.

2. Contract for Supply of Goods

a. We will acknowledge your order in writing, either by e-mail or post.

b. No contract will exist between you and us until we send you an order acceptance, either by e-mail or post. This will generally be when we have received payment and the order has been despatched.

3. Prices and Availability

a. The prices displayed on the site are correct at the time of display but we reserve the right to change them from time to time. Once an order has been accepted, the prices for that order will not change.

b. The prices do not include delivery. For orders through our site it is a weight based charge as shown separately on the shopping trolley. For other orders we will advise you prior to accepting your order.

c. The goods are subject to availability.

4. Delivery and Returns

a. We only supply to addresses in the uk served by Royal Mail who are our usual carrier.

b. You may return goods within seven days of delivery for any reason. you must notify us within seven days of delivery in writing by post or e-mail.

c. We will only refund the cost of the goods if they are returned unopened and suitable for resale as new unless the reason for returning them is that they are defective or damaged upon delivery. The costs of returning the goods will be refunded only in the case of us having delivered damaged or defective goods.

d. We will process the refunds within 30 days.

5. Payment

a. For all credit and debit cards we use the worldpay system operated by the Royal Bank of Scotland. we have agreed to the terms and conditions of this service. Please see http://www.worldpay.com/about_us/index.php?page=tandc for full details.

b. For sterling cheques drawn on a UK Clearing Bank, we will not despatch goods until the cheque has cleared.

6. Warranty and Liability

a. Nothing in these terms and conditions will restrict our liability for death or personal injury resulting from our negligence, neither will any of these terms restrict any of your statutory rights.

b. We will not be in breach of contract or these terms and conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of god, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

c. Except as set out in 6(a) our maximum liability arising out of any contract for the supply of goods will be limited to the retail price of the goods in the order.

7. Privacy and Data Protection

a. We collect and use information about you in accordance with the Data Protection Act 1998. we are registered with the Information Commissioner for this.

b. The data is used to process and deliver your order and to provide you with the best possible service. We do not disclose information to third parties except for delivery and payment purposes or if legally required so to do.
